Brief Description



The main purpose of this position is to recoup capital exported from the Republic of South Africa (the Republic) in contravention of the Exchange Control Regulations, investigate alleged exchange control contraventions, assist in the process of prosecuting offenders, and manage the effective functioning and performance of team members.

Detailed Description



The successful candidate will be responsible for the following key performance areas:



· Recouping capital illegally exported from the Republic

· Co-ordinating legal proceedings by, and against, the Financial Surveillance Department (FinSurv)

· Providing verbal and written legal opinions on a variety of matters pertaining to litigation involving FinSurv

· Preparing legal advice

· Drafting and amending existing legislation administered by FinSurv

· Drafting legal documents on behalf of FinSurv

· Assisting in the drafting or finalisation of agreements and memorandums of understanding

· Managing and co-ordinating matters affecting the contractual and related legal liability of FinSurv

· Overseeing the training and supervision of team members in the Investigations Division

· Performing all general legal services functions in FinSurv

· Furnishing management information

· Making recommendations and giving expert advice on exchange control matters

· Investigating alleged contraventions of the Exchange Control Regulations

· Assisting colleagues, the South African Police Service and the Office of the National Director of Public Prosecutions during investigations and prosecutions of alleged exchange control contraventions.

Job Requirements



To be considered for this position, candidates must have

· an appropriate, recognised legal qualification;

· at least three years at management or supervisory level;

· practical knowledge of, and experience in, the litigation process and Rules of Court;

· experience in pleadings and the questioning of witnesses;

· knowledge of, and experience in, among other things, the Law of Evidence, Law of Contract, Civil Procedure, Interpretation of Statutes and Constitutional Law;

· five years’ relevant administrative and investigative experience in the banking or financial environment;

· good communication skills (verbal and written); and

· a valid driver’s licence.
