Description


Job Purpose

Risk Management through cost effective legal recovery of outstanding bad debt exposure within the Absa Vehicle and Asset Finance (AVAF) Legal Collections portfolio by instructing 3rd party professional service providers and engaging with internal customers in the legal, insolvency, estate late and debt counselling processes.

Key Responsibilities

• Assess the risk position by analysing the overall security position to ensure the correct level of impairment is raised on the ARMS system
• Perform robust financial and non-financial analysis on the client that will support and underpin the recovery strategy to be implemented
• Assess Risk Management applications for legal clients within own mandate and approve ordecline these applications or recommend
• Formulate the appropriate recovery strategy to recover as much as possible and to mitigate additional requirements
• Instruct panel attorney to institute legal action against liable parties and management of legal process until the matter is resolved
• Initiate and approve any negotiations or settlement proposals within personal discretion and refer one level up should the settlement exceed personal mandates.
• Provide ongoing instructions to attorney inclusive of evidence required
• Draw and submit claim and documentation required in liquidations or sequestrations and deceased estates
• Produce relevant management information and statistics i.e. monthly group listings
• Manage bad debt exposures by taking daily legal recovery decisions and reviewing information from various systems and taking loss decisions accordingly
• Complete required compliance and SOX attestations
• Report risk and loss events as a result of fraud or error
• Monitor progress on defended or opposed matters in consultation with Group Legal
• Engage with higher levels on a matter to matter basis regarding complex settlements, decision
• Provide instructions to 3rd party service providers as first point of entry with clear guidelines
• Maintain effective and professional working relationships with attorneys, insolvency practitioners and auctioneers
• Manage legal risks associated with the legal recovery portfolio of clients
• Embed and maintain internal stakeholder relationships with Business Units
• Prepare reports, Watchlist Committee strategy sheets, Group listings and ad hoc MI request from internal stakeholders
• Optimize recovery cash flows by implementing effective and timely action
• Ensure that security values on ARMS are updated and correct as to ensure that losses are accurately accounted
• Investigate and question 3rd party fees and commission invoices including Liquidation and Distribution Accounts

Qualifications


Minimum Requirements

• B Degree in LLB or BPROC or BComm or equivalent NQF level 6 qualification or higher
• Three (3) years wholesale credit, legal or insolvency experience
• Proficient in MS Office (Word, Excel, PowerPoint and Outlook) and the Internet
• No criminal record

Preferred Requirements

• AIPSA Insolvency Diploma
• Three (3) years Commercial and business acuman with proven track record
• Three (3) years Proven success in a customer-facing role with significant negotiation skills
• Preference will be given to South African Citizens and Permanent residents of South Africa in possession of proof of permanent resident status
